any registered businesses that are in need of brand and marketing communications services, and which are accepted as a Client by the Agency Partner maintaining the right to decline the provision of Services to companies related to fossil fuels, harmful chemicals, mining, alcohol, tobacco, cannabis, leather, meat, dairy, fast food industries or any other business practices that are not aligned to the Agency Partner’s ethical standards;

“Agency Partner/We/Us/Our”

Water Lily Pond Ltd, a limited company registered in England under company number 9001389. Registered address: Unit 10, 80 Lytham Road, Fulwood, Preston PR2 3AQ, United Kingdom. Represented by the sole company director, Mate Kovacs;

“Cookie”

a small text file placed on your computer or device by The Site when you visit certain parts of The Site and/or when you use certain features of The Site. Details of the Cookies used by The Site are set out below;

“Personal Data”

any and all data that relates to an identifiable person who can be directly or indirectly identified from that data, as defined by EU Regulation 2016/679 General Data Protection Regulation (“GDPR”);

Expert Pitch Review and/or Pitches of Paradise, which are paid Services that can be ordered and purchased on The Site;

“Services”

brand and marketing communications consultation and advice regarding pitch decks, and/or creative development of pitch decks, which are provided by the Agency Partner to the Client as specified in the Product Order (and confirmed in the Order Confirmation); 

“Product Fees”

the prices of Product(s) that are specified on The Site;

“Product Order”

order placed for the Product(s) via The Site;

“Pitch Deck”

the pitch deck that was developed by you and regarding which you need advice, consultancy or creative development services;

“Order Confirmation”

The Agency Partner’s acceptance and confirmation of a Product Order, sent by email to the Client.

What does this policy cover?

This Privacy Policy applies only to your use of The Site. The Site may contain links to other websites. We do not collect technical information. Our third-party analytics provider, Google Analytics, and our third-party marketing providers, Drift and Constant Contact, collect technical details including IP address, browser type and version, operating system. Our legitimate interest is to be able to communicate with you, share marketing information with you regarding our company and Services, and analyse The Site to improve user experience.

With your permission and/or where permitted by law, we may also use your Personal Data for marketing purposes, which may include contacting you by email and/or telephone and/or text message and/or post with information, news and offers on Products and Services. You will not be sent any unlawful marketing or spam. We will always work to fully protect your rights and comply with our obligations under the Data Protection Legislation and the Privacy and Electronic Communications (EC Directive) Regulations 2003, and you will always have the opportunity to opt out.

Third parties whose content appears on The Site may use third-party Cookies. Please note that we do not control the activities of such third parties, nor the data that they collect and use themselves, and we advise you to check the privacy policies of any such third parties.

We will only use your Personal Data for the purpose(s) for which it was originally collected unless we reasonably believe that another purpose is compatible with that or those original purpose(s) and need to use your Personal Data for that purpose. If we use your Personal Data in this way and you wish us to explain how the new purpose is compatible with the original, please contact us.

How long will we keep your Personal Data?

We will not keep your Personal Data for any longer than is necessary in light of the reason(s) for which it was first collected. Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

How and where do we store or transfer your Personal Data?

We will only store or transfer your Personal Data within the European Economic Area (the “EEA”). The EEA consists of all EU member states, plus Norway, Iceland and Liechtenstein. How do we process orders and payments?

When you wish to order our Services and place a Product Order on The Site, you will need to select the Product, make a payment of the Product Fees for the selected Product, and accept and sign the Services Agreement. When required, both parties may accept and sign the Non-Disclosure Agreement as well. 

No part of The Site constitutes a contractual offer capable of acceptance. A Product Order constitutes a contractual offer made by you that the Agency Partner may, at its discretion, accept. Acceptance is indicated by sending the Client an Order Confirmation by email.  

In order to be able to provide the Services for the selected Product, we must receive your Pitch Deck. Therefore, the Client must prepare and share the Pitch Deck in advance, and ensure it’s in a format and state that is sufficient for the Agency Partner to work on. 

In order to process the payment we use Stripe, a third-party payment processor. The payment will be processed by Stripe, who collect, use and process Personal Data, including payment information, in accordance with their privacy policies.

Stripe’s services in Europe are provided by a Stripe affiliate—Stripe Payments Europe Limited (“Stripe Payments Europe”)—an entity located in Ireland. In providing Stripe services, Stripe Payments Europe transfers Personal Data to Stripe, Inc. in the US.

We collect and use Personal Data from individuals and businesses who place a Product Order on The Site in accordance with this section. When you place a Product Order, we collect your first name, last name, email address, phone number, billing address, company name (if applicable) and VAT number (if applicable).

If you do not provide this information, you will not be able to purchase the Products from us on The Site or enter into a contract with us. 

If you order one of Products, we obtain limited information about your payment card from our payment processor, such as the last four digits, the country of issuance and the expiration date. 

We have a legal obligation to issue you with an invoice for the Products you purchase from us where you are VAT registered and we require the mandatory information collected by our checkout form for this purpose. We also have a legal obligation to keep accounting records, including records of transactions.

How do we communicate with you?

You may provide us with your contact details via live chat, by sending us an email, calling us on the phone, by sending text messages or messages via WhatsApp, or when placing a Product Order. 

When you opt in for marketing communications, we will use the information you provide in order to contact you regarding our content, Products and Services. We will never send you marketing emails of any kind without your express consent.
